PRESS STATEMENT
ON THE MINISTER H. KAMP PROPOSAL
TO EXPELL UNEMPLOYED EU MEMBER STATE CITIZENS FROM THE NETHERLANDS
On the 14th of February 2011 minister Henk Kamp of Social Policy and Employment stated during his visit to the municipality Westland that unemployed Poles will be approached by the government in order to leave the country. In case he/she fails to do so, or would notoriously come back, such person can be given an "unwelcomed foreigner" status in the Netherlands.
Dominant majority of Polish citizens that came to The Netherlands is working hard both to the benefit of their families and the Dutch economy. They usually appreciate their stay here and are regarded by the Dutch employers as hardworking and highly motivated workers. The vast majority of Polish citizens abide the Dutch law, rules and sometimes even customs.
The Embassy of the Republic of Poland in the Netherlands is of opinion that given the current legal framework within the European Union, a fact of the EU citizen being unemployed or homeless should not automatically lead to an administrative decision of expulsion from the Netherlands.

In the view of Poland, any national policies aiming to revise the free movement of citizens of the EU should remain in conformity with the conditions set out in European legislation in force - DIRECTIVE 2004/38/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, especially the provisions of article 14 stating:
14.3. "An expulsion measure shall not be the automatic consequence of a Union citizen's or his or her family member's recourse to the social assistance system of the host Member State."
14.4. "... an expulsion measure may in no case be adopted against Union citizens or their family members if:
(a) the Union citizens are workers or self-employed persons, or
(b) the Union citizens entered the territory of the host Member State in order to seek employment. In this case, the Union citizens and their family members may not be expelled for as long as the Union citizens can provide evidence that they are continuing to seek employment and that they have a genuine chance of being engaged."
